“The proposed "Advertiser Settlement Class" includes any person or entity who, between April 20, 2003 and July 22, 2008, had ads hosted by Publishers on, and/or paid commissions for ads placed through, Defendants' online affiliate marketing network. The Advertiser Settlement Class shall not include any persons who already have settled or otherwise compromised their claims relating to the subject matter of this Litigation against the Defendants or any persons who are subject to Exclusion from the Class. The proposed "Publisher Settlement Class" includes any person or entity who between April 20, 2003 and July 22, 2008, hosted ads on behalf of Advertisers in, and/or received commissions for participating as a publisher in, Defendants' online affiliate marketing network. The Publisher Settlement Class shall not include any persons who already have settled or otherwise compromised their claims relating to the subject matter of this Litigation or any persons who are subject to Exclusion from the Class.”
